Juli hat der Internationale Gerichtshof (IGH) festgestellt, dass alle Staaten verpflichtet sind, den Klimaschutz vor sch\u00e4dlichen Treibhausgasemissionen zu gew\u00e4hrleisten. Das Gutachten macht deutlich, dass diese Verpflichtungen sich aus dem V\u00f6lkergewohnheitsrecht ergeben und somit auch f\u00fcr Staaten gelten, die nicht Vertragsparteien relevanter Vertr\u00e4ge wie dem Pariser Abkommen von 2015 sind.<\/p>\n\n\n\n<p>In diesem Zusammenhang sind alle Staaten verpflichtet, \u201ealle ihnen zur Verf\u00fcgung stehenden Mittel einzusetzen, um zu verhindern, dass Aktivit\u00e4ten, die ihrer Hoheitsgewalt oder Kontrolle unterliegen, erhebliche Sch\u00e4den verursachen\u201c. Dies umfasst auch die Regulierung privater Akteure. Der IGH stellte au\u00dferdem fest, dass jeder Versto\u00df eine v\u00f6lkerrechtswidrige Handlung darstellen w\u00fcrde, die eine staatliche Verantwortung nach sich zieht, und nannte als m\u00f6gliches Beispiel die Subventionierung fossiler Brennstoffe.<\/p>\n\n\n\n<p>Das Gutachten folgte auf eine&nbsp;<a href=\"https:\/\/documents.un.org\/doc\/undoc\/ltd\/n23\/094\/52\/pdf\/n2309452.pdf\">Resolution der UN-Generalversammlung<\/a>&nbsp;aus dem Jahr 2023, in der der IGH aufgefordert wurde, die v\u00f6lkerrechtlichen Verpflichtungen der Staaten zum Schutz des Klimasystems und anderer Teile der Umwelt sowie die rechtlichen Folgen zu pr\u00fcfen, wenn Staaten erhebliche Sch\u00e4den verursacht haben. Eine Kerngruppe von 18 L\u00e4ndern unter der F\u00fchrung von Vanuatu hatte die Resolution vorgeschlagen, nachdem die Pacific Island Students Fighting for Climate Change und die World Youth for Climate Change eine beharrliche Kampagne gef\u00fchrt hatten.<\/p>\n\n\n\n<p>\u201eFranciscans International begr\u00fc\u00dft die Entscheidung des IGH als Meilenstein in unserem Kampf f\u00fcr Klimagerechtigkeit und als Erinnerung daran, was ein nachhaltiges Engagement der Zivilgesellschaft erreichen kann. Wir haben uns besonders dar\u00fcber gefreut, dass der Gerichtshof das Recht auf eine gesunde Umwelt ber\u00fccksichtigt hat, das f\u00fcr die Franziskaner ein zentrales Thema ist\u201c, sagte Budi Tjahjono, International Advocacy Director von FI. \u201eNach dieser Stellungnahme gibt es f\u00fcr die Staaten keine Entschuldigung mehr, sinnvolle Ma\u00dfnahmen zu ergreifen.\u201c<\/p>\n\n\n\n<p>Der IGH ging auch auf das Recht auf eine saubere, gesunde und nachhaltige Umwelt (R2HE) als Menschenrecht ein und stellte fest, dass es \u201eaus der Wechselbeziehung zwischen Menschenrechten und Umweltschutz resultiert\u201c. Er kam zu dem Schluss, dass \u201edas Menschenrecht auf eine saubere, gesunde und nachhaltige Umwelt f\u00fcr die Wahrnehmung anderer Menschenrechte unerl\u00e4sslich ist\u201c.<\/p>\n\n\n\n<p>Bei den Vereinten Nationen thematisiert FI konsequent die Klimakrise und ihre Folgen f\u00fcr die Wahrnehmung des R2HE. Zu den j\u00fcngsten F\u00e4llen geh\u00f6ren die Folgen der Aktivit\u00e4ten im Bereich fossiler Brennstoffe in der Verde-Insel-Passage auf den Philippinen und in Cabo Delgado, Mosambik. Auf den Salomonen unterst\u00fctzt FI die Franziskaner bei der Bew\u00e4ltigung der Auswirkungen des Klimawandels auf K\u00fcstengemeinden. In Brasilien und Guatemala fordern Franziskaner sowohl vom Staat als auch vom privaten Sektor Rechenschaft f\u00fcr Menschenrechtsverletzungen im Zusammenhang mit dem Abbau von Mineralien f\u00fcr die Energiewende. Die Feststellungen des IGH, insbesondere seine Schlussfolgerung, dass sich die Verpflichtungen des Staates auch auf private Akteure erstrecken, werden eine weitere wichtige Grundlage f\u00fcr unsere Advocacy-Arbeit bilden.<\/p>\n\n\n\n<p>Das Gutachten wird bereits als Meilenstein gefeiert und wird von Aktivisten, zivilgesellschaftlichen Organisationen und anderen genutzt werden, um sicherzustellen, dass Staaten ihren internationalen Verpflichtungen nachkommen und dass Klimaverschmutzung und Umweltungerechtigkeit ein Ende finden. Wie der Gerichtshof betont hat, ist der Klimawandel ein \u201eexistentielles Problem, das alle Lebensformen und die Gesundheit unseres Planeten gef\u00e4hrdet\u201c \u2013 es ist an der Zeit, dass die Staaten sich der gef\u00e4hrlichen Lage stellen, in der wir uns befinden.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote has-small-font-size is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Dies ist eine automatische \u00dcbersetzung.
